Xcellence Inspection Services provides professional residential and commercial property inspection services. Our services may include, but are not limited to:

Buyer and seller home inspections
Pre-listing inspections

All inspections are performed in accordance with applicable state licensing requirements and industry standards. Our inspection reports are prepared for the exclusive use of the client who contracted the inspection and are not transferable.

3. Use of Website

You agree to use our website only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations. You may not:

Use the website in any way that violates applicable law or regulation;
Transmit any unsolicited or unauthorized advertising or promotional material;
Attempt to gain unauthorized access to any portion of the website or its related systems; or

6. Scheduling & Cancellations

Inspection appointments are confirmed upon receipt of a signed inspection agreement and, where required, a deposit or full payment. We reserve the right to reschedule or cancel an appointment due to unsafe conditions, weather, or circumstances beyond our control.

Clients who need to cancel or reschedule are asked to provide at least 24 hours’ notice. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee as outlined in your inspection agreement.

7. Payment Terms

Payment for inspection services is due at or before the time of the inspection unless otherwise agreed in writing. We accept payment by credit card, check, or other methods as specified at the time of booking. We reserve the right to withhold delivery of the inspection report until payment is received in full.

8. Inspection Report & Limitations

Our inspection reports are prepared in accordance with applicable state standards of practice and represent a visual assessment of the property’s accessible and observable systems and components at the time of inspection.

The report is not a guarantee, warranty, or certification of any kind.

Xcellence Inspection Services is not responsible for conditions that were not visible, accessible, or discoverable at the time of inspection, including but not limited to concealed defects, conditions behind walls, or items not within the scope of a standard home inspection.

9. Privacy Policy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and protect your personal information, including SMS consent data.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Xcellence Inspection Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, website, or communications, including SMS messages, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or related to an inspection shall not exceed the fee paid for that specific inspection.

11. Indemnification

You agree to indemnify, defend, and hold harmless Xcellence Inspection Services, its owners, employees, agents, and representatives from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorney’s fees, arising out of or in any way related to your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which Xcellence Inspection Services operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that state.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on our website with an updated effective date. Your continued use of our website or services following any changes constitutes your acceptance of the revised Terms.
